A Primer on Matrimonial Law in New York

I will be giving an overview of New York divorce law at Fordham Law School on January 24, 2015 for the Bridge the Gap CLE along with Veronica Escobar titled “A Primer on Matrimonial Law in New York.”

Veronica and I will give an overview of New York matrimonial law beginning with the two different paths to divorce: the contested and uncontested divorce. We will discuss Alternative Dispute Resolution and the jurisdictional differences between Family Court and Supreme Court in New York as it applies to matrimonial and family law disputes. We will also discuss the following issues as they apply to divorces:

1. Grounds for Divorce (including the no fault ground)
2. Child Custody and Visitation (including forensic evaluation, relocation, and parental alienation)
3. Child Support
4. Spousal Maintenance (temporary and durational)
5. Equitable Distribution (including business evaluations)

We will conclude with an overview of prenuptial/postnuptial agreements and family offenses.  Stay tuned for more details!
