Illinois Family Law: Parenting Time and Shelter in Place

We have received a lot of questions from folks about what to do about parenting time orders in the midst of a shelter in place.The current Shelter in Place Executive Order in Response to COVID-19 presently in place specifically excludes under Paragraph 14(e) “[t]ravel required by law enforcement or court order, including to transport children pursuant to a custody agreement.” A full copy of Executive Order No. 8 can be viewed at https://www2.illinois.gov/IISNews/21288-Gov._Pritzker_Stay_at_Home_Order.pdf (last visited March 31, 2020.  Although we are in uncharted territory and the judges have given no advisory opinions, courts will likely enforce parenting time orders in light of this exception unless there is known exposure to Coronovirus.
